Acceptance of Terms

The following terms and conditions refer to the services provided by Westend Photography (https://westendphotography.com.au/) and your rights as a client. If you are not using our services, the following terms do not apply to you.

“You” and “Your” refer to the client of our services. This can be an individual seeking our photography services or a representative working on their behalf. By using our services and agreeing to these terms, you accept our conditions. “We,” “Our,” and “Us” refer to Westend Photography (https://westendphotography.com.au/).

We may update or change the information on our website or within our services anytime to provide the best photography possible service.

Intellectual Property Rights

All content, images, and materials provided by Westend Photography are regulated by intellectual property laws. So, unauthorized use, reproduction, or distribution of our content is strictly prohibited. Clients may not change or create copyrighted images from our photographs without having written permission. You agree to respect our intellectual property rights by using our services. Any violation of these rights may result in legal action to protect our rights and interests.

Ownership, Copyright, and Permission for Use

Westend Photography has the right of full ownership and copyright of all photographs taken during sessions. Clients receive limited personal usage rights. In that case, the unauthorized reproduction, distribution, or modification of images is prohibited. By using our services, you agree to these terms and grant us permission to use images for promotional purposes while keeping your personal use rights.

Deposit & Payment Terms

We will need a 50% deposit to confirm your booking. All deposits are non-refundable, although rescheduling is possible depending on the situation. Westend Photography accepts all major credit cards and EFT bank transfers. We will also consider payment plans on request.

Studio Terms and Conditions/Policy

Full Family group portrait Session.

  • All adults must attend both the photography session and the purchasing appointment.
  • A $50 deposit is required to secure your booking into our dairy for all appointments. This deposit will be refunded or credited towards your order on the day of your design appointment. The deposit is not refunded if you give us less than 3 days’ notice for your appointment. This covers the loss of the appointment sessions and design appointment and your photographer’s time. Booking deposits are non-transferable.
  • The session must be booked prior to the expiry date.
  • No kids under 5 after 5 pm.
  • Images are not to be used for commercial use.
  • One gift voucher, per family, per year (for experience-based clients).
  • Opening time is 10-6 pm, plus one Saturday of every month.
  • Please advise us of any injuries, food allergies or special circumstances that may affect your pet during the session.
  • Photography sessions can be quite active and involve physical activities. Any injuries need to be told to the photographer prior to the session. You must participate in your photography session at your own risk.
  • Any offers may not be used in conjunction with any other offer and voucher and is not redeemable for cash or any other goods and may only be used as described. The offer is not transferable.
  • Your cinematic reveal + design appointment must be scheduled no longer than 2 weeks from your photography session to redeem your gift voucher benefits.
  • Management reserves the right to refuse service at any time.
  • We respect your privacy and personal information is not shared with any third party or other organizations.
  • Special offers cannot be used to purchase fine art portraits in any form, from a previous portrait session.
  • All images are products included in a single offer or special, must be a full family portrait and all the same portrait.

Cancellations & Rescheduling

For outdoor sessions, you may change your schedule due to bad weather or switch to a studio session without losing your deposit. We understand emergencies happen, so we will consider rescheduling on a situational basis. You should note that all booking deposits are non-transferable. If you need to reschedule the session, please contact us as soon as possible to schedule a new date.

Refunds

Deposits are not refunded if you give us less than three days’ notice for your appointment. This policy compensates for the loss of the appointment sessions, design appointments, and your photographer’s time. Please note that booking deposits are non-transferable.

Modifications to Services and Fees

Fees for our services are subject to change without any notice. Westend Photography reserves the right to modify or discontinue any service at any time. These changes can happen without prior notice or liability to you. We are not responsible for any price changes or discontinuations of services. By continuing to use our services, you agree to any changes.

Accuracy of Billing and Account Information

We reserve the right to refuse any order. At our discretion, we may limit or cancel any order. So, please ensure your account details, including email and payment information, are current and accurate. If we modify or cancel any order, we will inform you using the contact information provided at the time of purchase.

Changes to Terms

Westend Photography has the right to change these terms and conditions at any time. Any changes will be communicated through our website or promotion emails. If you have questions regarding our terms and conditions, feel free to knock us!
